You should at all times take the appropriate measures when using the grounds of the recreational area. Please bear in mind that pools and tennis courts carry their own inherent risks. We have no liability for any death or personal injury arising from use of or connected with the swimming pool and tennis court, except to the extent that such liability cannot be excluded by law. For further details please see our Guidebook and Health & Safety Protocol.
a. The pool and pool area:
1. Fence protection around the pool is not required. If you require a fenced pool, you must inform us of that requirement before you make your booking.
2. You must ensure that you and all members of your group take great care when using or being near the swimming pool. Be aware of the depth and layout of the pool by physically checking it prior to use. Do not run around or near the pool, do not dive into the pool and do not enter the pool under the influence of alcohol. Before use you must check the pool and report any apparent defects. Read the pool notices. Children in your group should be continuously supervised.
b. The tennis courts
1. Tennis is a highly competitive, fast action game in which physical conditioning plays a major role. Because of the speed with which the game is played, you must take all precautionary measures before using the court. Check the court and report any apparent defects before starting your game.
2. Use appropriate clothing, eye protection -specifically designed for racquet sports is strongly suggested for children- and sunscreen. Net jumping, racquets throwing and other horseplay is prohibited.
The Grounds of the Property:
The villa is located in fenced large grounds with clear boundaries and signed escape routes. Grounds:
Be cautious when exploring the grounds while you familiarize yourself with the buildings and gardens. The woodlands contain drops and/or uneven grounds that carry their own inherent risks and therefore children have to be supervised.
Terraces:
The property has undergone a limited conservation project because it is a listed historic building. The untouched sea-front terraces have low heights and the staircases may feature drops and other risks. These may not be suitable for people with limited mobility. Please take reasonable care when using these and ensure that children are never left unsupervised and must not be allowed to climb or walls. We have no liability for any death or personal injury arising from the use of or connected with the terrace(s) except to the extent that such liability cannot be excluded by law.
Special requests, medical conditions, disabilities and reduced mobility
1. Special requests:
If you have any special request, you must clearly advise us at the time of booking.
Although we will listen with empathy and endeavor to satisfy any reasonable requests, we regret we cannot guarantee any request unless it has been specifically confirmed in writing. Failure to meet any special request will not otherwise be a breach of contract on our part. An acknowledgement from us that a special request has been noted or passed on to the House Manager or that the special request is written in your confirmation invoice or any other documentation, is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. We regret we cannot accept any conditional bookings relevant with the fulfillment of a particular request.
Childcare and babysitting assistance:
We do understand that some of our guests require childcare and babysitting assistance but we are unable to recommend providers. Therefore, any arrangements which you might make with local staff are entirely at your discretion. We do not vet or check local staff for suitability for providing childcare. If you wish we can arrange you do so. We cannot accept any responsibility or liability for such arrangements.
Medical conditions and limited mobility:
If you, or any of your group, have any medical condition, disability or reduced mobility which may affect any aspect of your booking process, you must inform us before you confirm your booking so that we can advise you as to the suitability of the property and assist with the booking process. In any event, you must give us full details in writing at the time of booking. If the condition, disability or reduced mobility only develops or deteriorates after you have booked, as soon as you become aware of it.

Your rights to make changes to your confirmed booking:
1. Changing your booking: We will make every effort to assist you if you wish to alter your booking arrangement, but it may not be always possible. Kindly inform us as early as possible to minimize the burden of effort and cost and to avoid cancellation of your holiday with us.
2. How to request a change: You might wish changes in your booking after we have issued you a confirmation invoice. You must notify us in writing as soon as possible. We will let you know if the change is possible. If it is possible, we will inform you about any changes to the price of the property or anything else which would be necessary as a result of your requested change. We will then ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, -i.e. as an increase in the price-, you may want to cancel your booking.
3. Changing your group size: Changes to your group size can be made as follows: You can reduce your group size at any time prior to departure. This will not entitle you to any reduction in the total price of your booking nor any refund on monies already paid (deposit or balance). You may also wish to increase your group size prior to departure, but it cannot be above the maximum occupancy of the property.
4. Transferring your booking: If you wish to transfer your booking to someone else, it must be to a person or persons who agree to be bound by these terms and conditions, and who must meet any requirements of the original booking in question. If in our reasonable opinion, the property is not suitable for the person or persons to whom you wish to transfer the booking, we reserve the right to refuse to make the transfer. If these transfer conditions are not met, your booking will be treated as cancelled by you and you will have to pay our cancellation charges.
5. Changing the date of your booking. If you want to change the date of your booking to a date in the same calendar year, please let us know in writing. We will inform you whether the alternative date is available, and if it is, the charges you will need to pay in order to make the change. Any date change requests must be submitted at least 9 weeks before departure or soon after the time of booking -if within 9 weeks of departure- otherwise, our aforementioned cancellation charges will apply.
Moving of your booking:
Please consider the following:
a. If you are moving your booking to a week in a lower price than your original booking, the price of your original booking will still apply.
b. If you are moving your booking to a week at a higher price than your original booking, the higher price will apply. The difference in the price payable, as a result, will be communicated to you and will need to be paid in order to make the change.
c. Any change of booking for the following calendar year (or beyond), will be treated as a cancellation of the original booking and a new booking will need to be made.
d. Cancellation charges will apply to the original booking.
If you wish to cancel your confirmed booking:
1. Your right to cancel your booking. You may cancel your confirmed booking at any time prior to arrival. All cancellations must be in writing. The Lead Booker must write to us. Your notice of cancellation will only be effective when you have received our acknowledgement email. Cancellation charges will apply.
2. How we calculate our cancellation charges. In calculating the cancellation charges we have taken into account the expected cost savings, potential loss of income and the alternative deployment of the property to mitigate this loss. Cancellation charges are shown as a percentage, and they are calculated on the confirmation invoice cost.
How we will refund you:
If there is any refund due to you when you cancel, we will refund you the price you paid for your chosen arrangements by the same method you used for payment, less the applicable cancellation charge.
Comprehensive travel insurance required:
Kindly note the importance of taking out a comprehensive travel insurance prior to or at the time of booking. Depending on the reason for canceling your booking, you may be able to reclaim these cancellation charges. Claims must be made directly to the insurance company concerned and we can supply a cancellation invoice upon request.

Cancellation made between 42 and 29 days before arrival: 80 % of reservation value

Villa Posillipo is a luxury accommodation that sleeps max ten (10) adults and two infants. The property can also be booked for intimate elopement weddings and private events. Bookings that include an event have seven (7) nights minimum stay.
You must agree and sign the property's booking terms and conditions before agreeing to book Villa Posillipo. If an event is part of your stay, special event booking terms and conditions apply that you should sign before booking.
Deciding factor. Please note that if loud music and dancing is an important part of your event, and therefore your stay at the villa, please note that strict event terms and conditions and noise restrictions imposed, should be a deciding factor before you book the accommodation.

You must ensure that the property is right for you.
It is your responsibility to ensure that you have read the property profile and local area description and that you have selected Villa Posillipo because it suits your requirements. If you, or any of your group, have any specific requirements or requests you must communicate this to us prior to your booking.
You must tell us who is in your group.
Prior to departure, it is essential that you provide us with the details of all persons in your group. The use of the property, its grounds and amenities are strictly reserved for the group named on the booking. Inviting other people (friends or external suppliers) into the property during your stay, even if they are not sleeping at the property, is only possible with our prior written consent.
When you must pay.
When you must pay depends on when you booked.
a. To secure your booking you pay the deposit at the time of booking and the balance not less than 9 weeks prior to departure or full payment at the time of booking if within 9 weeks of departure. (clause 6.6.)
b. Your deposit is 30% at the time of booking. (clause 5.7.)
c. If you have paid a deposit, the balance of the cost of the property is payable not less than 9 weeks before the start of your booking, unless it is within 9 weeks prior to departure or you are informed otherwise at the time of booking.
d. The balance due date will be shown on the confirmation invoice. (clauses 4.1.; 5.7.)
e. A reminder will be sent to your registered email address. Balance payment can be made via bank transfer or debit card only. (clause 5.7.)
Charges for cancellation of booking.

If you wish to arrange additional activities while you are away, please check your policy before doing so. Read your insurance policy details carefully and take them with you. If you choose to travel without adequate insurance cover, we will not be liable for any losses suffered by you in respect of which insurance covers would otherwise have been available. (clause 7.6.).
2. House Guidebook. You are required to make yourself familiar with (and comply with any rules or restrictions) set out in the property Guidebook. You will be sent via email the Guidebook before your arrival.
3. Guest Conduct. You are expected to conduct yourself in an orderly and acceptable manner.
a. If in our opinion, the opinion of the property staff, of any of our suppliers or of any other person in authority, your behavior or that of any member of your group is causing or is likely to cause distress, danger or annoyance or damage to property, we reserve the right to terminate your booking immediately with no further liability to you.
b. You and/or your group may also be required to pay for loss and/or damage caused by your actions and you and each member of your group will be jointly and individually liable for any damage or losses caused. Full payment for any such damage or losses must be paid directly prior to departure. We will also take reasonable steps to cover our financial losses if the damages force us to cancel our next booking.
c. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us because of your actions together with all costs we incur in pursuing any claim against you.
d. We cannot be held responsible for the actions or behavior of other guests or individuals who have no connection with your booking arrangements or with us.
Our responsibilities
1. Our duty to use reasonable skill and care: We take all precautions and maintain rigorous quality control and comprehensive service assessments to ensure safety and quality during your stay at the property. We have chosen our suppliers and providers with reasonable skill and care. We have no liability to you for the actual provision of the property, except in cases where it is proved that we have breached that duty and damage to you has been caused. Therefore, we will have no liability to you for anything that happens at the property or any acts or omissions of the property or others.
2. Our responsibility for your acts or acts of third parties: We will not be responsible for any injury, illness, death, loss (including loss of possessions or enjoyment), damage, expense, cost or other sum or claim of any nature whatsoever which results from acts and/or omissions of any of the persons affected; or acts and/or omission of a third party not connected with the provision of the property and which acts and/or omissions were unforeseeable or unavoidable.
3. We do not have responsibility for anything we have not agreed to provide: We cannot accept responsibility for any services that do not form part of our contract and we have not agreed to arrange them as part of your booking. For experiences you might require during your stay, you will be assisted by our villa specialist. “Experience Booking Terms and Conditions” apply.
4. Our responsibility for losses that are unforeseeable: We cannot accept any liability for any damage, loss, expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not reasonably have foreseen you would suffer or incur if we breached our contract with you, or which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally, we cannot accept liability for any expenses or losses that relate to or arise from any business (including without limitation, self-employed loss of earnings), or any indirect or consequential loss of any kind.
5. We do not exclude or limit in any way our lawful liability: This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or for fraud or fraudulent misrepresentation.

Our responsibility for losses that are unforeseeable: We cannot accept any liability for any damage, loss, expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not reasonably have foreseen you would suffer or incur if we breached our contract with you, or which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally, we cannot accept liability for any expenses or losses that relate to or arise from any business (including without limitation, self-employed loss of earnings), or any indirect or consequential loss of any kind.
5. We do not exclude or limit in any way our lawful liability: This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or for fraud or fraudulent misrepresentation.
